MoSim

1. License

We grant you a limited, non-exclusive, non-transferable license to play the Game, and a revocable license to create custom robots ("Mods") using the Repository and mod system. You own your original Mod content. You don't own the Game, its assets, or the Repository. Your ability to play a copy you purchased through a store platform is governed by that platform, not by us.

2. Ownership and Branding

The Game, its code, its 3D assets and CAD models, its UI, and the names and logos "MoSim," "MoSimulator," and "Cascade Studios" are our property. Some of our tools, including MoSim Builder, are released under open-source licenses that cover their code and assets, and you may not present any program as the official Game or as affiliated with us using our names, logos, or UI assets from the Game, including both inside and out of any derivative project you release. Naming a derivative project descriptively (for example, including "MoSim Builder" as part of the name) is fine; passing a project off as the official Game is not.

3. What You May Not Do

You agree not to:

  • Reverse-engineer, decompile, or extract CAD files, 3D models, or other proprietary assets from the Game, the Repository, or other Mods, except where this restriction is prohibited by law;
  • Circumvent, disable, or bypass any encryption, access control, version gating, or other technical protection measure in the Game;
  • Distribute Mods anywhere other than through our official submission system;
  • Charge money for Mods or Mod-creation services, or place Mods or related content behind a paywall;
  • Include malicious code, malware, or spyware in a Mod;
  • Infringe anyone's intellectual property in a Mod.

This conduct is also separately prohibited under United States law, including the DMCA (17 U.S.C. § 1201) and copyright law, and under equivalent protections in other jurisdictions.

4. Supported Versions

Online play, leaderboard submission, mod submission, and other services we operate require a currently supported version of the Game, such as the latest public release and any legacy modding version(s) we designate as supported. Using an unsupported version limits access to those services only; it does not otherwise affect you.

5. Repository License

By accepting this Agreement, you agree that your use of the Repository is governed by the version of the Repository license currently published at https://github.com/MoSimulator/MoSimulator-Public/blob/main/LICENSE, which supersedes any earlier version you may have obtained. This applies going forward from your acceptance and does not change the terms that applied before then.

6. Identification and Enforcement Data

To enforce this Agreement and the Repository license, we may collect and store your Steam ID and/or Discord ID to identify users who violate these terms, including through alternate accounts. We do not sell or share this data, and we will not disclose it except where required by law or necessary to pursue or defend a legal claim.

7. Your Data Rights

We process the identifiers in Section 6 on the basis of our legitimate interest in protecting the Game and its assets, and retain them only as long as needed for that purpose. You may request access to or deletion of the data we hold about you at mosimulator@gmail.com, subject to our need to retain data connected to an active or anticipated enforcement matter. Depending on where you live, you may have additional rights under laws such as the GDPR, PIPEDA, or your local equivalent.

8. Enforcement and Termination

We may blacklist, remove, or modify any Mod that violates these terms, and may suspend or terminate your access to the mod system, online services, mod submission, and the Repository if you violate this Agreement. This does not affect your ownership of any copy of the Game purchased through a store platform.

9. Promotional Use

By submitting or publicly sharing a Mod, you grant us a royalty-free, worldwide license to use your Mod along with screenshots, videos, and derivative media for promotional and marketing materials for the Game.

10. Indemnification

You are responsible for the Mods you create. If a Mod you distribute infringes someone else's intellectual property or otherwise causes a third-party claim against us, you agree to cover the resulting costs and liabilities to the extent the claim arises from your Mod.

11. Disclaimer and Liability

The Game and Repository are provided "as is," without warranty of any kind. To the maximum extent permitted by law, we are not liable for any damages arising from your use of the Game or Repository.

12. Governing Law

This Agreement is governed by the laws of the State of South Carolina, USA, and applicable United States federal law, without regard to conflict-of-laws rules.

13. Changes

We may update this Agreement and require you to accept the updated version to keep using the Game, the mod system, or the Repository. Continued use after an update means you accept the current version.

14. Miscellaneous

If any part of this Agreement is unenforceable, the rest still applies. Sections 2, 3, 6, 7, 8, 10, 11, and 12 survive termination.
